These Terms & Conditions (“Terms”) govern your access to and use of vljconstruction.net (the “Site”), operated by VLJ Construction Services, Inc. (“VLJ Construction,” “VLJ,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
These Terms govern use of the Site only. Construction, hauling, milling, concrete recycling, and related services are provided under separate written subcontracts, purchase orders, work orders, or agreements. If anything in these Terms conflicts with a signed agreement between you and VLJ Construction, the signed agreement controls.
1. About VLJ Construction and the Site
VLJ Construction Services, Inc. is a Florida construction subcontractor based in Riverview, Florida. The Site provides information about our services, capacity, and company. It is not an offer, contract, or solicitation to enter into any agreement for construction services. All work is performed under a separate written agreement signed by both parties.
2. Bid Invitations, RFPs, and Inquiries
You may use the Site to send us bid invitations, requests for proposals, plans, and general inquiries. Information you submit through the Site is an inquiry only. It does not create a contract, reserve equipment or hauling capacity, or obligate either party. Submitting a bid invitation or RFP does not obligate VLJ Construction to submit a bid or perform work, and any proposal we provide is subject to our own terms, project conditions, material and fuel costs, scheduling, and a written subcontract or agreement. Capacity, pricing, and schedule information on the Site or in our replies is provided for planning purposes and is subject to confirmation.
You represent that information you submit is accurate and that you are authorized to submit it on behalf of any business or agency you identify. Bid documents you send us are handled in the ordinary course of business as business-confidential; however, the Site forms are not a secure channel for trade secrets or restricted documents. Contact us to arrange another method of exchange for such materials.
3. Independent Owner-Operators
VLJ Construction operates its own milling equipment and crews. Tri-axle dump truck hauling is coordinated by our dispatch team through a network of independent owner-operators and hauling companies. Each hauler operates its own business, holds its own operating authority and insurance, and is responsible for its own compliance with federal and state transportation regulations. Nothing on the Site creates an employment, agency, partnership, or joint venture relationship between VLJ Construction and any hauler, applicant, or Site visitor.
4. Use of the Site
You may use the Site for lawful purposes related to evaluating, contacting, or working with VLJ Construction. You agree not to:
- Use the Site in violation of any applicable law or regulation
- Attempt to gain unauthorized access to the Site, its servers, or any connected system
- Introduce malware, or interfere with or disrupt the Site or its infrastructure
- Use automated means to scrape, harvest, or collect information from the Site beyond what a publicly available robots.txt and standard search-engine indexing permit
- Submit false, misleading, or fraudulent information through any form on the Site
- Use the Site or our contact details to transmit unsolicited commercial messages
5. Intellectual Property
All content on the Site — including text, graphics, logos, photographs, project descriptions, page layouts, and the Site’s design — is owned by VLJ Construction Services, Inc. or its licensors and is protected by United States copyright and trademark law. The “VLJ Construction” name and star logo are trademarks of VLJ Construction Services, Inc. You may view and print pages for your own business use in evaluating our services. You may not otherwise reproduce, republish, distribute, or create derivative works from Site content without our prior written permission. If you believe content on the Site infringes your rights, contact us using the details below and we will respond promptly.
6. Project Information and Photographs
Photographs, descriptions, and statistics about our work are representative examples. They are not guarantees of future results. Project scope, methods, materials, schedule, and pricing for any engagement will be specified in a separate written agreement.
7. Email Newsletter
By subscribing to our newsletter you agree to receive periodic email updates from VLJ Construction. You can unsubscribe at any time using the link in any email or by contacting us. Our handling of your email address is described in the Privacy Policy.
8. Third-Party Links and Services
The Site may link to third-party websites and uses third-party services such as Cloudflare Turnstile, Google Analytics, and Google Fonts. We do not control third-party sites and are not responsible for their content, availability, or privacy practices. Links are provided for convenience and do not imply endorsement.
9. Disclaimer of Warranties
The Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, or that content is complete, current, or accurate.
Informational content on the Site — including blog articles discussing FDOT specifications, regulations, funding, weather planning, and industry practices — is general information, not legal, engineering, or professional advice. Specifications and regulations change. Verify current requirements with the applicable agency and consult qualified professionals before relying on any statement for a specific project.
10. Limitation of Liability
To the fullest extent permitted by law, VLJ Construction Services, Inc. and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, arising out of or relating to your use of the Site, whether based in contract, tort, strict liability, or otherwise, even if advised of the possibility of such damages. Our total aggregate liability arising out of your use of the Site shall not exceed one hundred U.S. dollars (US$100).
Nothing in these Terms limits liability that cannot be limited under applicable law. This section applies to use of the Site and does not modify the liability provisions of any separate signed agreement.
11. Indemnification
You agree to indemnify and hold harmless VLJ Construction Services, Inc. and its officers, directors, employees, and agents from claims, damages, losses, and reasonable attorneys’ fees arising out of your misuse of the Site, your violation of these Terms, or your violation of any law or third-party right.
12. Privacy and Accessibility
Our Privacy Policy explains what information we collect and how we use it, and is incorporated into these Terms. Our Accessibility Statement describes our commitment to making the Site usable by everyone.
13. Changes to the Site and These Terms
We may modify, suspend, or discontinue any part of the Site at any time without notice. We may also update these Terms; the revised version will be posted here with an updated “Last updated” date and takes effect when posted. Your continued use of the Site after changes are posted constitutes acceptance.
14. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any action arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Hillsborough County, Florida, and you consent to the personal jurisdiction of those courts.
15. Severability and Entire Agreement
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with the Privacy Policy, constitute the entire agreement between you and VLJ Construction regarding use of the Site.
